I. General Provisions

These Terms and Conditions of Sale (“T&Cs”) govern all purchases made from Back Bay Consumer Products Private Limited (“BackBay”, “we”, “our”, “us”) through our website (the “Website”). The T&Cs are accessible at all times on the Website. BackBay reserves the right to update or modify these T&Cs at any time. The version applicable to a transaction is the one published on the Website at the time of order confirmation. By placing an order, the customer (“Client”, “you”) agrees to comply fully and unconditionally with these T&Cs.

II. Website Information and Access

BackBay operates as an e-commerce business. The Website is generally accessible 24 hours a day, 7 days a week, subject to interruptions for maintenance, upgrades, security measures, or circumstances beyond our control (“force majeure events” as recognized under Indian law). BackBay is not liable for any damages resulting from Website unavailability. We do not guarantee uninterrupted or error-free access to the Website or its services. Temporary suspensions may occur, without prior notice, for technical or security reasons. By using the Website, you acknowledge and accept such interruptions. BackBay also reserves the right to update, improve, or modify the Website for technical, legal, or commercial reasons. If such updates do not materially affect the services provided, your acceptance will not be required.

III. Account Creation and Registration

To place an order, Clients must create a personal account (“Account”) by providing accurate and complete details. Once validated, confirmation will be sent via email. The Client is responsible for ensuring that personal information provided is correct and up to date. BackBay shall not be held responsible for delivery issues caused by inaccurate or incomplete details. Clients may register more quickly by using third-party services (e.g., Facebook Connect). In such cases, Clients remain responsible for verifying the accuracy of the information. Please refer to the third-party’s privacy policy for data handling practices. Eligibility to place orders requires that Clients:

  • Are of legal age (majority under Indian law).
  • Have full legal capacity to enter into contracts.
  • Hold a valid payment method accepted by BackBay’s payment partners.

BackBay reserves the right, at its discretion, to refuse registration, reject orders, or suspend/close accounts, particularly in cases of suspected fraud, misuse, or ongoing disputes.

IV. Products

Products offered for sale are those listed on the Website, subject to availability. Stock levels are updated regularly; however, errors or stock depletion may occur. BackBay shall not be held responsible for cancellations arising from unavailability. We take care to provide accurate product descriptions and images. However, minor discrepancies may occur, which Clients acknowledge and accept. In rare cases, a Client may receive an item that has been previously returned by another customer. Only unused, intact, and quality-checked items are restocked and offered for sale. If a delivered product does not conform to its description on the Website, Clients may exercise their right of withdrawal or request an exchange/refund in accordance with applicable consumer protection laws.

V. Orders

Orders placed on the Website follow the process established by BackBay. The shopping cart (“Cart”) allows Clients to review, add, or remove products at any stage before confirming the purchase. The Cart displays selected items along with their prices, GST, and shipping charges (excluding customs duties and local taxes applicable outside India). Clients are responsible for paying any such additional charges directly to carriers or authorities. By confirming an order, the Client accepts these T&Cs. An order confirmation email will be sent summarizing the details (products, quantities, availability, and total price). Invoices are accessible in the Client’s Account section.

VI. Order Refusal or Cancellation

BackBay reserves the right to:

  • Withdraw products from the Website at any time.
  • Update or modify product descriptions and related content.
  • Refuse or cancel orders, even after email confirmation, in cases such as product unavailability, suspected fraud, or payment disputes.

If an order is cancelled after payment, a full refund will be issued. BackBay is not liable to Clients or third parties for product removal, modifications, or order refusals.

VII. Prices and Payment Terms

All prices are displayed in Indian Rupees (₹) for domestic orders and in U.S. Dollars (USD) for international orders. Prices are inclusive of Goods & Services Tax (GST) but exclusive of customs duties or other international charges. BackBay reserves the right to adjust prices at any time. However, the applicable price is the one shown at the time of order confirmation, subject to availability. Payment is due at the time of order placement and can be made through:

  • PayPal, or
  • BackBay’s secure payment partner (PayU).

By submitting payment details, the Client authorizes BackBay and its partners to process the transaction. Payment card details are processed securely by PayU and are never stored by BackBay. In case of payment failure, BackBay reserves the right to cancel the order and inform the Client by email. Note for international customers: All orders are processed and shipped from India. Some banks may charge foreign transaction fees. BackBay does not levy such charges. Clients should check with their bank or card issuer before purchase.
